Hope you're ok avinaj80? Rear enders can and have a strong tendency of coming back later to aggravate you-physically, so be sure to get yourself checked out by the Dr's. It's important to have that on record too in case you do start to have problems later. Cars can be repaired, but it's the sick feeling of having your pony wounded and knowing it will never be the same that's hard to get over. I'm a strong believer that rear enders are not accidents, they're acts of negligence due to driver inattentiveness and the laws for this need to be tougher and more in favor of the innocent than the guilty. I had a 1989 Taurus LX, bought new, was rear ended and totaled in 1997, 2 days before Christmas. It was in mint condition with ony 35K miles and naturally we didnt get in insurance payment what the car was truly worth and ended up having to replace it with a lesser quality and valued car, just wasn't right. IMO the person taking the car away from us, should have had to replace it in kind, even if it cost more than the book value. We knew we'd never find another 1989 Taurus LX with only 35K miles and in mint condition and definately not one for the money we were given, so the whole orderal sucked. We need a law that requires the quilty to not only pay book value but an additional % on top of that to offset the inconvenience and aggravation the innocent will have to go thru. Maybe I'll run for Congress and create this Bill!!!!!
There is no way to pay for the slight damage and strain that is placed on the rest of the car that is involved in a crash. Simply putting a new bumper on it is never going to be enough. But insurance companies are always quick to collect money but always slow to dish it out.....
Glad you are ok at least...Hope it all works out alright. My friend also got rear ended and hit the car in front of him also. The person who hit my friend also did not have insurance and now they are going through that whole battle. In the end, you can take it to court but if they dont have a job or no means of income, there really wont be any way to get money. Just try and scare him/her into giving up money. Hopefully it will all work in your favor and once again I'm sorry that your stang had to be hit.

Thanks for all the replies guys. I am ok, no injuries. I took a week vacation to go and get married, so all is good. I am taking my car in to get repaired this week and should have it back within a week. I am taking it to a body shop who I know does really good work, the shop I work at sends them all of our body work needing cars. So i am gonna get a couple of mods done to it while it is there. Just exhaust and maybe a roush front valance, or the street scene valance. I had just recently changed my insurance carrier to Wawanesa which I think is only available in California and Oregon. Very good insurance company. They called me back promptly and sent a claim adjuster down to asses the damage to my car. They got in contact with the opposing driver, my adjuster told me he was being a complete jerk with her, even cussed her out, so she sent in an SR1 form with the Calif. DMV and got his license pulled, I kinda feel bad because he drives a service truck for his job. Should I feel bad? Probably not, but I guess it is just my nature. He shouldn't talk to people like that. Thanks for all the replies guys. I need to upload some pics of the before and after. I kinda fixed a little of the damage myself, but you will see how bad it was. take it easy guys. -Jose-
My thoughts are...no insurance, no car. DMV should make a check with insurance companies each month, on each vehicle...no insurance, then the registration should be pulled...just like yanking driver's licenses...I guess it's similar to folks who don't have any kind of medical insurance...it's the rest of us, who have insurance, who pay their medical bills...just my two cents worth!
California actually has a new law now that targets drivers with no insurance. Makes the insurance companies report to the DMV once the policy expires. It takes 2 weeks to a month which is a really bad flaw, but at least it is there. I'm just glad my car is getting fixed with me only having to pay the deductible.... Take it easy guys. -Jose-
My sympathies...I too got hit in the rear end in my stang awhile back, but nothing as severe as yours. I only needed to have the rear bumper cover repaired and repainted. The guy that hit me was a complete jerk too...screaming his fool head off...just made him look bad in front of the cops. They talked to me real nice and wrote him up for following too closely. I don't understand how all of these states have these people running around without car insurance. Here in KY, the license plate (tag) is tied to you having insurance. If you can't provide proof of insurance then you can't renew your tag for the next year and you can't drive the car. If you don't pay your insurance bill in the middle of the year, the insurance co is required by law to notify the police. The insurance is tied to the vehicle, not the person.

Wow that sucks alot glad to hear that your alright, you have no reason to feel bad, teh guy hit you and is being a jerk about it, getting his lisence will just prevent it from happening to someone else, and hopefully teach him a lesson.
On another note hitting a Mustang and refusing to repair it should be listed as one of the criteria for capital punishment

I'd like that system to be put into effect in NJ. we have over million driver's without insurance
