Default CAI and CA smog testing

Will a CAI cause me to fail my CA smog test? I put a B&K CAI on my '07 V6 when I lived in Mississippi. I never had any problems when I was down south, but my engine light has been on since Ive been here. However, the car is running perfectly.

The light came on once before when I was visiting KY, and the Ford dealer said it was because of the gas blend they use in that area (CAI made it run too lean, I believe). I temporarily fixed it by running higher octane (and maybe a bottle of octane boost), but I'm concerned that doing that out here in CA will cause me to fail the smog test.

Any ideas how to make the engine light go out and still pass the test (other than installing factory air intake)?

You need a tune so that the fuel doesn't run to lean. If the fuel runs lean you not only will have a check engine light, but it could cause serious engine damage. As far as the smog test, I don't think it will cause any issues because the smog is based on your emissions. Also I suggest not using octane booster, they tend to leave a lot of sediment in your engine.
