Obviously it is going to be a relatively long, tricky process to try to enforce your contract. Calpony seems to have a pretty good handle on the pertinent California statutes. Call the attorney he referred you to, if for no other reason, to get advice from an attorney practicing in that state and area of law. As advised by several, get your documentation in order and go after him. Any correspondence between you and the scammer are going to be very important, especially if he has admitted to accepting your money, selling the car to another person, and trying to sell you a different car.

Thumbs up Matbe an opening in this matter

Thanks calponymike,..You gave me a lot of wisdom and am happy with all you guys giving feedback on my question.
Yesterday 22.00 hours Dutch time I did win the auction of Mustang2Cobra where he offers another mustang. He did mail me that I could have the car for 10.000 if i would transfer the balance of 1500.-. I have this written in an e-mail. I now bought this car through ebay and already contacted him. As far as it looks now he will cooperate. He told through the phone that there where a lot of misunderstandings and that he is a serious seller and not a scammer. So for now I hope this all works out and I can have normal night rests again.

I don't mean to be negative, but if the car in the thumbnail is supposed to be the Mustang2Cobra, it is not; I'd be VERY leary of dealing with this person. Also, ditto on running everything through EBAY to get whatever protection they offer on this purchase. Again, KEEP ALL DOCUMENTATION OF ALL COMMUNICATIONS INVOLVING THIS TRANSACTION.

I have contacted this guy in California and have been told there is another side to this story.
Of course there are 2 sides to every story then there is the Exact truth.

Perhaps he will give his side of the story ?

There is only ONE truth, however, it is like watching a football game through 2 different knotholes in a fence. Each sees the game from a different angle.

I believe Calpony had found this wasn't the first or only time this seller had been involved in a transaction wherein the buyer felt he had been taken. Not to judge without knowing all the facts, but, why not simply refund the guys money? He doesn't have the car the guy bought, he can't deliver title for the car the guy bought...

Yesterday the car is brought to Rinkens for transport to Holland, thanks to you guys this all worked out. MIL1ION yes every story has two sides. Unfortunately i was not alone in my problems. But Steve fixed our problems and that is the only thing that counts for me. So everybody thanks especially the person who tipped us buying his other car through ebay.

If you get this worked out you are extremely lucky. From what it sounds like, the guy is trying to fix things.

Trying to get criminal charges on this would be a nightmare. Local LE handles local problems, interstate problems are handed federally through the FBI. This in international problem. California will say it is a problem for the authorities in the Netherlands as it is where the victim lives, and the Netherlands will say report it to California.

If it doesn’t work out take the given advise and contact an attorney in California who knows California law, and there is a good chance they might charge you a lot to research the international law.

But hopefully this will take care of itself.

Yep and the other guy that was ripped off was me. To make a long story very short. This guy is a fraud! First of all he is an illegal car dealer, no license whatsoever. I found at least 5 other persons on the net being ripped off by him. I sent him money for the shipping to pay fotr the cargo. He never did, had to pay twice to get the car shipped. Once the car arrived, I discovered 2 huge holes in the floor and powersteering was not installed, missing power steering cilinder.
Nothing but trouble wit this guy. Note: Even if you buy via Ebay, you are only protected for the vehicle program, if both accounts and banks of seller and buyer are located in the US8 Protection is not valid overseas.
Anyway, I did all things possible, even taped all the tel calls on videotape. He still owes me 1450 USD. I reported him to local authorities, Ebay, IC3, and DMV in California.
Today I checked his Ebay account and saw that it is suspended, finally....

Try to get in touch with a lawyer to see what your rights are and how to go about getting what is yours. Some times they won't charge a fee just for asking. It sucks that there are nasty people in the world....Best of luck to you!
