The appeal is because of the method used to get the charges dropped.
The 4 star general and colonel who broke the very strict UCMJ rules against Improper Command Interference got criticized by the judge (full colonel) hearing the case and he threw out the charges against Lt.Col. Chessani.
All the layers of command under Chessani had been cleared earlier EXCEPT for the senior NCO on site who had actually ordered the houses cleared (if anyone is responsible for misconduct, it is he).
Had the case been heard it would almost certainly have been won by Chessani on merit.
What we are seeing now is CYA for extremely senior personnel who got caught breaking the rules and pushing a political agenda.
It will be interesting to see if the Staff Sergeant is found innocent as well. If improper behavior occurred with regard to Lt. Col. Chessani, how could it NOT have also happened in the case of the Sergeant?
