I don't think there should be any charges but killing someone with a sword is somewhat harsh. But you don't go towards a 21 yr old that has a sword(scared sh*tless) and try to pin them. You end up getting cut.

Wow. Just the thought of him being charged kinda makes me angry. As far as I'm concerned, as soon as the the guy crossed over the property line he was at his own risk and he pretty much got what he deserved. I can't say that I wouldn't have grabbed soething to defend myself with before walking out of the door to check the garage. At my house it would have been a machete that I keep with my hiking gear cuz it's in the closet by my back door.
Others may not agree but I say good for him.

Charges? The guy defended himself. Not even his property. He waited until the burglar was accosting him before he used the sword. That's straight up self defense in the strictest definition of the term. Only someone who buys into the Obama Dictionary would try to charge this student with anything.

I'm glad the laws in my state address this. In TN, we have no duty to retreat as long as we are legally allowed to be in a location and not engaged in illegal activity (whether we are in our home, on a public sidewalk or wherever.) Further, we are justified in using deadly force if we have a reasonable fear of death or serious bodily injury and the law specifically says that we are automatically assumed to be justified in such fear if someone illegally enters or is attempting to enter our residence. Further, the law specifically spells out that a porch, the 'curtilage' (yard) and any buildings included in such curtilage are considered to be part of our residence. Of course, we are not allowed to use deadly force specifically to protect property but if we take a weapon with us to investigate a noise and are then attacked then the force is being used in self-defense, not defense of property. In other words, in the state of TN, as long as events really went as this article say they went, the law would protect the homeowner - or, in this case, the renter.
As in so many cases where a gun is blamed for gun crime, there is a tone to this article that seems to want to focus on the weapon used rather than the simple fact that this was self defense. To me, self defense is self defense I don't care if the assailant is shot, stabbed with a butcher knife (or a sword) or has his skull split with a stone axe.
Further, what the hell does it matter if he had training with the sword or not? It's like studying whether a resident who shoots an intruder in self defense goes to the shooting range regularly.

What? This guy manages to defend himself with a sword and suddenly Dibble assumes the guy is training to be the next Bruce Lee? Just because a person grabs what is handy to use in self defense does not mean that person has advanced, formal training with that item. Heck, a few months back a 17 year old used a space heater to defend his mom from intruders - bashed one of the intruders in the head and killed him. So was that kid a master of the deadly, ancient art of smallappliancefu? I am pretty confident in my ability to defend my home with my 12 gauge, I generally hold it with two hands and am confident that I know what I am doing - heck, I even practice with it some, on my own - but I wouldn't exactly compare myself to John Rambo.
Of course, my feeling is that he got lucky with the sword and might want to consider other options for home defense. He can pick up a NIB Maverick Security 88 for about what is sounds like he paid for that sword - maybe less.

He should have called the police. Instead, he left the safety of his house with a weapon to go out of his way to confront someone outside. That is the job of the police. No the job of the police is to show up after the crime and write a nice written report on it. There are times when calling the police is the smartest thing to do. In this case a call to the police probably would of ended up having the cop ask if you had any serial numbers for the stolen items he got away with, or if your real lucky they would of picked him up, put him in jail for a night then have him get out and break in to another house the following night. The founding fathers of this country knew you had the right to defend yourself and your property. You can’t use lethal force to protect property but if you go without a weapon it may be a lethal force encounter….against you. If the scumbag is dumb enough to lunge at someone with a gun or sword then too bad.
