I agree. This has little to do with religion, but all to do with democracy and having a westerner in among them.
But keep in mind that being charged and being convicted are two different things... even in other countries. So we need to see where this goes. But the simple fact that she was charged is telling in itself... and quite sad actually.

They held an Islamic Law trial in Saudi Arabia after they caught 7 men who abducted a woman and repeatedly raped her.
The 7 were found guilty of the crime, and will start serving their sentences of 10 to 60 months (yes, MONTHS).
Meanwhile, the rape victim will receive 200 lashes (usually administered in public) for having the bad taste to be snatched and raped.
Should she survive the punishment (such lashings often result in death or permanent disability in and of themselves), she will be ostracized for the rest of her life.

Seems she either gets the 40 lashes, or 6 months in jail (or however long it actually is), or has to pay a fine. It's not both, it's just one of the three... Still... It might go a lot of different directions. The three source articles I read had the phrase "40 lashes AND (my emphasis added) 6 months in prison", where 1 article had the pharse "40 lashes, 6 months in jail, OR a fine".
Language and context can be important.
Off hand, I would think that politics, as usual, will play a big role. Sudan has recently been feeling put upon by the Western powers (particularly the U.S. and the U.K.). This might well be just another act of defiance. In that case, the choice of punishment (and the length of time it all draws out) will be determined by the Sudanese wackos, er, government, as fits their geo-political agenda.
The lady is just a helpless pawn in a very large game.
