Default legal help please!

so on my way to work today in heading westbound in the left hand lane and a guy making a right into on comming traffic doesnt look adn turns all the way into the left lane and hits my car. he then speeds up and so i catch up and make him pull over about 4 blocks later. he gets out and askes what happened? i show him the damage done to the passenger side of my car. i called the cops but i guess in ca they only have to show up if there is bodily damage?? (i went down to the police station and filed a report.) so we exchange information and the guy leaves. i go to work and call both insurance companies and find out his insurance was canceled?? my insurance covers uninsured drivers but only to 3500. so after work i get home and 20 min later the guy is at my door with two other guys and wants to talk to me so i tell him i will talk to him monday after i hear back from the insurance companies. he admits infront of my mom and a friend that he was in a hurry he was late to work. the he tries to tell me he didnt understand what i was saying to him this morning cause his english isnt good?? we talked for ten min while waiting for the police that didnt come. i not sure what to do, ive never been in an accident or even pulled over before. and all this had to happen the day after i finish up my suspension upgrades and a complete detail of my car!!!

doesnt that suck. i detailed my car and hit a deer the next morning and wiped out my whole frt end.$5,000.00 worth. i would think this guy is gonna be in a heap of trouble, but in the end, you might not get anything out of him. the deer hit cost me 100.00 comprehensive but i dont know about your deal, or how your insurance company will handle it. let us know.

well seeing as my insurance company is going to have to pay for it id think they will sue him or maybe i will have to sue him? thats what i need to find out by i have to wait until monday to talk to an adjuster from either company? unless somebody here as know how in situations like this and can help

dude, that is the worst! he messed up your beautiful ride! i really wouldnt expect it to be more than 3500 to repair some body panels, unless theres more damage underneath that i cant see

If your insurance only covers $3500. . . I'm not sure if that is going to cover that much damage. . . My 03 Cobra was hit by an 88 year old man the other day. It put a TINY ding in my passenger quarter panel. $700.00 in damage, and it is extremely small. If the insurance doesn't cover the damage, I would call a lawyer and see what your options are. Also, don't get a cheap job on it. Cheap body work ends up costing you more in the long run. From the pics he got your rear bumper, your passenger door, and your passenger fender?

holy cow, 700!?!?! i got my front DR side fender cranked by some daddys girl a week after i bought my car, and the whole panel had to be replaced and painted and it cost 280 bucks. i mean, its no cobra...but 700?!?!?!

bottom line is-->call your insurance company and start a claim; that is why you have insurance; they will handle it for you; in my experience with High Point (formerly Prudential), with both homeowner's and auto insurance, whenever I've needed them, they handled it all from start to finish with no problem. Let them earn their keep- I'm sure you're paying them a lot of money!

That's the cost of taking off all surrounding body pieces, some panels from inside the car, body work, paint, and clearcoat. I was very persistant that it had to be a perfect job.

my thinking is they are going to have to paint the whole car. the rear bumper has pressure cracks on the rear near the lettering and deep scratches on the side. the fender will need to be replaced its badly bent and gouged. the door can probably just be buffed and painted. but i doubt the paint will match and i will not have mismatched paint job on my car. i know a few ppl who own body shops so as soon as i talk to my insurance adjuster on monday i will begin looking for the best deal and best work. i wonder if i can get the parts myself from a junk yard and have the body shop put them on and paint the car? anybody who has been through this please help. i just completely bummed out and have no clue what im doing.

Once you get the check from the insurance company you can do whatever you want. They are going to pay a set amount. For instance, instead of them just repainting my rear bumper and painting that area of the car to repair my ding I am having the OEM front and rear bumpers installed and painted, along with having the hood redone. Insurance is picking up $700.00 of the tab and I am picking up the other $800.00 of the paint / body work.

so my insurance company will come look at my car and tell me what they are willing to pay? then i take that and go to body shops and get prices?

Depends, If the work costs more then they say sometimes the insurance company will send more money to the shop after the shop faxes photos ect. I hope it works like that for you. . . I'd still try to go after that guy with no insurance. 1. He hit your Cobra, that's grounds enough lol 2. He's a complete jerk for driving without insurance 3. Your going to have to pay your deductable to get this fixed (since he doesn't have insurance). It's taking a lot of your time, along with your car being in the shop for who knows how long.

yeah your right i will probably go after him. i talked to a few other ppl and they told me that my insurance company is one if the best at taking care of their customers cause its a government company USAA

If you have his info we could all meet up and Mustang intimidate him by showing up at his house in some 30+ Mustangs and make him pay for everything. And is it just me or does it seem to be Mustang bashing season. There are like 5 new threads this week about people's Mustangs being hit or damaged.

I'll share my experiance, My wife was hit by a cab driver in Wichita Ks. about year ago, the accident was his fault and he was given the ticket. Come to find out he had no insurance which was amazing in the fact that he was carrying a passenger at the time of the accident, the cab company claimed they were not responsable in any way and stated the drivers were responsable for there own insurance even though he was driving their cab with there name on it. Apparently they have no liability to even be responsable to make sure their drivers are carrying insurance. My cost was the $500.00 deductable I had to pay since my insurance covered me, plus of course a potential for a rate increase in my insurance. We sent a letter to the Kansas Attorney General, They couldn't help and said we would have to hire a laywer, a letter to the Better Business Bureau returned the same results, a letter to District Attorney.....the same results. We decided it did not make since to hire an attorney for the cost so we sent a letter to the local news and they did an interview with my wife and are getting ready to do a news story about consumer protection but that part of the story doesn't help you and I do not see it helping me in any way either accept perhaps in getting some personal satisfaction. My point is, depending on the laws in California you will probably have to hire an attorney to try to get anything back from the guy that hit you. Sorry for that news but at least you are allright besides a sore ankle and your car can be fixed though it will cost you your hard earned money to pay for it because the laws don't always protect the law abiding citizen.
