If the Florida guys that ended up in the pokey in Texas still have their tape where Hennessey suggests they are gay, the "terroristic threat" is greatly weakened, particularly as it becomes a portion of a "heated discussion" participated in by both sides.
Looks like Hennessey is actually operating a ponzi scheme. Selling off parts of new customers cars to satisfy old customers who have been waiting a year for their cars.
Looks like a classic, desperate situation of someone in over his head and willing to steal from customers to get through what he probably considers to be a "temporary emergency". The words "cash flow" spring to mind.
A good forensic accountant might well discover other problems - I'd start with withholding taxes for employees, and a review of charges made against customers' credit cards.
Law suits of this dimension can destroy a company.
Some friendly advice to Hennessey - the best you can do is try to start flying straight and get up to date with ALL your current customers, call those with legitimate beefs BEFORE they show up in a lawsuit, and keep your mouth shut.
Its possible it will blow over without wrecking your business.
But NOT if you try to be the tough guy, stonewalling your customers and pretending the lawsuits don't hurt.

You are correct on the above, he apparently got in over his head. -Car guys aren't necessarily good businessmen, look at Shelby and the independent ferrari beater he built a few years ago.
Ford was able to get him back, because he didn't have many options . ..

I came close to getting banned one time for posting a complaint (in my usual mild prose) about Cervini on a site. I stated that their products were good, but that post-sale you could not get them to respond to you if you had a problem. Or even a question.
I figured 4 long distance (no 800 number) calls, 2 snail mail letters, and 14 emails later, I had a right to gripe.
Moderators of the site (mustang site) came down on me, suggesting I was being hastey, should give them more time (a year without response had convinced me their customer service organization was brain dead), etc.
Then I got booted off (not banned, just sort of "suspended") with a nasty gram from the admiinstrator that I wasn't being fair and he was locking down the thread.
Turns out they were probably trying to do business with Cervini, and I stood in the way.
I stopped positng to sites linked to aftermarket (or oe corporate) sites after that.
Their loss, not mine. (Same for SRT, if they booted you - people that bring real information to the table, even when they don't agree with you, are the foundation of a good forum).
As for Hennessey, I have personal knowledge of one of his victims here in Atlanta. Suit has been in the works for 2 years - not settled yet. Involves about $100,000 originally in dispute, plus lots of lawyer costs since.
Maybe H is behaving himself nowadays. I'd advise him to stay off the forums.

I told them Daimler Benz treated their customers as if they were stupid, that Chrysler is simply working on German leftover platforms, and they have no respect for American engineering and it shows.
Chrysler will never have a chance at building a world class car, anymore just "heritage" stuff based on old platforms. Their commercials are condescending and almost filled with contempt for the "stupid" people in the commercials -from the Hemi-dude to the guy on whose lawn Dr.Z leaves an independent rear suspension.

yeah, I would've advised Shelby to quit suing the kit manufacturers, but those dudes are all wrapped up in their own "legend." since that's what they have to bank on.
Shelby/Henessey/Coddington/et al, all need corporate sponsorship to really make it. They need to be free to create stuff, and let the suits worry about management.

Chrysler's last American administration, who were the ones that sold themselves down the river (look it up, the source of the expression involves Africa and moving slaves down the rivers to the ports - often slaves that sold themselves in order to feed their famlies).
I was a voice at the time warning them that they were selling too cheap (Chrysler had just started turning themselves around; their new design center was just reaching full swing with some really good designs [some of which they are still using], and another year might well see them free and clear of needing Daimler Benz.
Also, I predicted then the arrival of Dr. Z, the closing of the shiney new American design center, and Chrysler subsisting on hand-me-down Mercedes platforms. (One reason for the lopped-off body designs, which hit a lucky home run with the 300, but did the opposite with the Charger).
Those mercedes platforms were designed for lots shorter cars.

I rather like Dr. Z (the concept can really work), but the little digs need to go - though I fear they are missed by most observers. Same thing with the ceomercials Bill Ford puts out, with the nonsense about Volvo engineering (while he's selling current Ford products designed by American engineers, whose work is winning safety and quality awards, NOT the current crop of Volvo guys!)
