NOT MY FAULT well Kinda....I was driving with a friend and I was going about 5mph to come to a stop...Nice day with some ice here and there....While I was Almost to a stop by brakes locked up on some Black ice slid into the car in front of me. she and I got out and looked at the damage. Nothing done to her ride and Mine has paint chipped and scratches....Cop gets there what do you know its the one that hates me....He gave me a $108 ticket and 4 points off....Is that even right to do ? Im pissed and am going to court for it. He told me I wasnt driving slow enough in these conditions....What just bcuz the salt truck couldnt put down some salt on the roads souldnt be my fault. the cop smiled at her and said she could leave....told me to get out and handed me my ticket...I argued for awhile and all he said was go fight it then....I said ( See ya there ). There were cars sliding in front of us as he was writing my ticket....STUPID!!! I just needed to Vent...Thanks

i agree, take it to court. theyre not gonna punish you further if you lose, so you might as well, right? besides, i think you have a case. glad it wasnt like a bad wreck or anything and that your alright
It's not the ice-truck's fault. You are supposed to drive in an appropriate manner for the conditions. So....yeah you should've been more cautious.
With that said, I also think you have a case anyways. I was issued a ticket when I rearended someone awhile back, but the judge threw it out when I told him the kid stopped at a green light. So good luck with the case
So the cop didn't even see how fast you were going? How would he know if you were driving wrong?
Not entirely sure, but I assume he got a ticket for "failure to stop" or "following too close". While there is not necessarily a law that defines "too close", the cops generally give a citation at the scene of an accident. Someone has to be at fault. At least that's what I was told (in Virginia) at my accident.
Yea, he pretty much is at fault since the person who rear ends someone is either too close or going too fast. But if he hit ice and slid I don't think he should get a ticket.

The transformation has begun!
Last year I was driving home from work late at night when I slid off the road into a ditch. There was no one around, so I called my roadside assistance. They told me the wait was going to be 90 minutes, and since my car had died, and it was freezing, they recommended that I call the local police. So I did. Long story short, tow truck comes, beats my car to hell, gets it up on the flatbed. Cops ask him to wait for a second. They come to the door, bringing me a ticket. "Failure to reduce speed in inclement conditions". THEY WEREN'T EVEN THERE WHEN I SLID!!! I was creeping along the exit ramp at 2 mph!!
Needless to say, I took it to court, and won.
Be careful on them roads out there!

Only thing that you can get ruled against is failure to control your vehicle. I got one after sliding five cars lengths into another car while the cop was right behind me. Sad thing is is that on the video you can even see me turning my wheels and nothing happening. Btw lost the fight judge was a jerk

The ticket was valid. But often times valid tickets can be tossed out for any number of reasons. And that does not mean they were not valid tickets. The same as an officer can choose to issue warnings and that does not mean the offense didn't happen. It is just how things go.
Failure to maintain control and driving too fast for the conditions are two tickets that an officer does not need to see things happen to issue. The end result is the proof, like it or not, of what happened. There can be good reasons for doing and then fighting both tickets, but the issuing of them is pretty standard.
Good luck in how you want to handle this.
