Default Well i hope one of you are a lawyer

I know this is out of the norm but i've been caught in a sticky situation and i figured i'd get your advice on what i should do since im so young and lack experience in these areas. As of late my mom and dad divorced and she waved spousel support in exchange for my dad making car payments(signed court documents) and for paying insurance on my 2001 mustang (which is in his name to lower the monthly payment and insurance).This past weekend while having my car out he wrecked it into a gaurdrail,we took it to the local body shop to get an estiment and were told that we would need the right fender and right bumper fixed and a new front bumper along with cai. After getting the fender off,the body shop informed us that the last owner must have been in a wreck and did a poor job fixing the fender and that the only way to fix the damage would be to order a new one which is 1800 installed with that added to my estimate it gives my car the ability to be totaled out.My dad is now planning to total my car(which i have 7,000 of my own money invested in from graduations and other gifts.)and plans to give me his 1995 rust bucket monte carlo as a way of ting out of making the monthly payment on the mustang. My cars my passion so im going out on a limb and hopeing maybe one of you have advice on the situation.

Sorry to hear about your problem...... Our fenders for our cars are only $80.00 or so for a brand new replacement. It sounds like your Dad is trying to inflate the price to get out of the payments. The insurance company will still have to send out an adjuster, just make sure you are there when it happens!!!! Heck when I hit the deer last year, my estimate came to $5400.00 and they didn't even blink when writing me the check to fix it. I also told the adjuster that I didn't him to total it. I didn't want the cash, I wanted my baby......

WOW Thats a bummer. I just recently had my car painted entirely and the insurance paid for all of it ( except for the deductible). Stick to you guns kids and keep your baby!!!!!!!!!!!

And how many estimates?

Sorry to say, but MANY body shops add 'extras' to boost their profit.

A used fender will work 100% as well as new.

It sucks that you are being put into a situation like this.

He wrecked it, so why are you having to suffer? He should be the one paying for the damage to repair it. I would make every effort to keep the car. If you're not able to do so, then you have a sticky situation.

Do you attempt to take him to court to provide you a vehicle or have him pay or damages so it isn't totalled out. If he tries to give you an old, paid-off, vehicle, what is going to happen to the money he's no longer paying as car payment/insurance. You & your mom should have a case for child/spousal support. Maybe you could use that money to get a new car.

i agree, i recently had a company truck hit my rear bumber on my 06 and i took it to get a estimate, well i wont name the company but its a popular one out here and they wanted $980 bux thats replacement, fixtures,paint and w.e else, so i took it to another shop and its only $570 so the same parts and fixtures so i think u might wanna take it to another shop and i bet it will be much cheaper.

Thanks for all the help you guys, i went down to the body shop that did my body kit and the est. was reduced huge. So i faxed it to the insurance adjuster and they said that they'll send the car down there to get fixed the only thing that their not fixing is the after market rims but i suppose there not that bad just a little scuff or 2 in them. Still breaks my heart seeing my baby all banged up
