Default some good news about California's smog laws

Dear Rene:

Thank you for contacting me with your opposition to SB 708 (Florez). Your
views on bills and issues facing the Legislature are very important to me.

During my 10+ years in the Legislature, I've consistently opposed efforts to
extend the state's smog check laws to classic cars because I don't think
requiring cars that are driven a few hundred or a few thousand miles a year
will significantly improve California's air quality. Furthermore, whatever
improvements are made are likely to be very expensive for classic car owners
and I have little doubt there are other places where California can get much
bigger air pollution reductions for a lot less money.

As you know, cars manufactured before 1974 are exempt from the state's smog
check laws and the exemption is a "rolling" one in that it will always apply
to cars that are 30 years old. So, in 2010, all cars made before 1980 will
be exempt from the smog check requirements of the law.

SB 708 orginally sought to change the 30-year rolling exemption to a 45-year
exemption, meaning in 2004, cars made between 1959 and 1974 that are now
exempt from the smog check laws would be required to undergo a smog check.

In response to the strong opposition from hundreds of classic car owners
around the state, Senator Florez has amended his bill in a way that should
take care of your concerns. The bill retains the 45-year rolling exemption,
but pre-1974 cars will remain exempt from the smog check laws if they're
driven less than 12,000 miles a year.

That amendment should allow true classic car owners to retain their smog
check exemption, but I'd certainly like to hear from you if you have any
further thoughts on this issue. SB 708 will be heard in the Senate
Transportation Committee on April 29, 2003. I'm not a member of that
committee, but if the bill passes, it will come before me in the Senate
Appropriations Committee or on the Senate floor.

I received that too from Rene, and it all sounds fine and dandy.... however, how are you going to police who is driving under 12000 per year, and who is not. And just because you dirve 13000 years, does it mean you are not a true classic car collector? And does it mean your car doesn't polute more the the car driven up 12000. Just some food for thought. It is not about smog, it is about money coming into the state.

The bottom line is; we can not let up on this issue. We can't let them pass this bill, show them that we do not want this changed.

FLOREZ REVERSES ON CLASSIC CAR SMOG RULES

SACRAMENTO -- With Jay Leno and the rest of California's classic car buffs on his case, State Sen. Dean Florez has dropped his proposal to require smog checks for cars as old as 1958 models.

Leno, "The Tonight Show" host who has a large collection of vintage autos, personally called Florez's office to lobby against the plan.

The lawmaker was also inundated with letters, e-mails and phone calls from many other members of the highly organized hobby car community.

One of their tools was a cartoon depicting Florez in his state-leased SUV chasing classic cars out of California.
Florez was forced to back down on the bill, one in a package of 10 bills aimed at cleaning up the air in the Central Valley, before it even got its first legislative hearing.

The bill, SB 708, isn't dead, but it has been amended to crack down on cars that emit visible smoke. Originally, it called for requiring regular smog checks and repairs for cars up to 45 model years old. If in effect this year, it would apply to cars made in 1958 or later. That would have replaced the state's existing exemption for cars older than 30 model years, which this year is 1973.

"Given all the fights we have on all the other air pollution bills," Florez said, "it wasn't going to help to push that one."

He said classic car fans made a convincing argument that most of the oldest cars on the road, while they may be some of the worst polluters, aren't usually driven to and from work daily.

"We told the classic car folks that we're going to continue to talk to them," Florez continued, "but that was just too much of a detailed type of proposal."

Florez's legislative aide, Michael Rubio, said Leno called after reading a newspaper article about the smog bills.
" He said he wanted to know what the deal was with (SB) 708," Rubio said. "Several days later, he called back and said, 'You've got me thinking now.' And I said 'Can I start at the beginning?'"

He said Leno listened carefully and discussed his thoughts on the smog problem and the bill at some length, urging Florez to carefully distinguish between older cars that are driven for basic transportation and those that are merely exhibited most of the time.

Other problems, he said, are the difficulty of getting repair parts for older cars and the fact that emission controls were not mandated on cars until the late 1960s.

The same arguments were made by the classic car community's chief lobbyist, Steve McDonald of the Special Equipment Marketing Association, a trade group of manufacturers, retailers, publishers and restorers.

"Obviously we're thrilled that the senator has agreed to modify the legislation and refocus the target on what we believe is a more effective one, that being smoking vehicles," McDonald said.

So are hobbyists like Jan VanderPool of Bakersfield, who, with his fiancée, owns three vintage Ford Mustangs.
" That's definitely a big relief to me," he said.

VanderPool said it took years and a lot of effort to get the rolling exemption from smog checks for cars that are more than 30 years old enacted in 1997.

Florez and his staff appeared surprised, if not shellshocked, at the size and aggressiveness of the lobbying campaign against the smog check proposal.

But it was no surprise to VanderPool, who has been through similar drills before when legislation was proposed that helped or hurt car hobbyists.

"A lot of us have had to get pretty political," he said. "We've had to get active and kind of watch our backs."

There were a lot of classics in 1974... even the Mustang II is a "classic" now... especially now that most of them are packing the power they lacked in the 70s (due to owner modifications)

Hmm a little narrow minded by that reconing my 66 would be a junker 8 years ago!!!!

Got to keep on top of the polititions as they spend way too much time with there heads in the clouds & snouts in the trough and loose touch with the real world if were not vigilant we'll all be driving 2 cylinder ricers so they can get the green vote.They forget the silent majority dont want to!!!

lol.... 12,000 miles a year?? How many of us really drive our projects THAT much?

Heck, not even my daily driver gets that much in a year... and I drive 40 miles (round trip) a day to work.

I do a 40 mile round trip to work 9,800m and another 5-10,000 driving around Dispite having several cars I would easily do more than 12,000 in the stang it's so much fun to drive and whats the point having a nice car if your not enjoying it!
